These Terms and Conditions (“Terms”) govern your use of ephemeralnetworks.com (the “Site”) and the training, membership, and informational services offered on it by Ephemeral Networks (“we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
Accounts
Some features require an account. You agree to provide accurate information, keep your login credentials confidential, and notify us of any unauthorized use. You are responsible for activity under your account. Accounts are for individual use and may not be shared.
Memberships, courses, and payments
Prices, billing intervals, and what each membership or course includes are shown at the time of purchase. Recurring memberships renew automatically until cancelled. You may cancel at any time, and cancellation takes effect at the end of the current billing period. Except where required by law or stated otherwise at the time of purchase, payments are non-refundable. We may change prices or course content going forward, and we will give notice of price changes before they apply to your renewal.
Acceptable use and ethical conduct
Our training teaches offensive and defensive security techniques. You agree to use these skills only on systems you own or are explicitly authorized to test, and only within our provided lab environments during training. You may not use the Site, its labs, or anything learned through it to access systems without authorization, disrupt services, or break any law. You also may not attempt to interfere with the Site, other users, or our infrastructure outside the scope of an exercise. We may suspend or terminate access for violations.
Intellectual property
All Site content, including course materials, videos, labs, text, graphics, and logos, belongs to Ephemeral Networks or its licensors and is protected by intellectual property laws. Your purchase gives you a personal, non-transferable license to access the content for your own learning. You may not copy, redistribute, resell, or publicly share course materials without our written permission. Tessaract is patent pending and is licensed separately under its own agreement.
Products and consulting services
Information on the Site about Tessaract and our consulting services is for general information. Product trials, licenses, and consulting engagements are governed by separate written agreements, which control if they conflict with these Terms.
No guarantee of outcomes
We work hard to prepare students for cybersecurity careers and certifications, but we do not guarantee employment, salary, certification results, or any particular outcome.
Disclaimers and limitation of liability
The Site and its content are provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. To the fullest extent permitted by law, Ephemeral Networks will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of the Site. Our total liability for any claim relating to the Site will not exceed the amount you paid us in the twelve months before the claim.
Third-party links and services
The Site may link to or use third-party websites and services. We are not responsible for their content or practices.
Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and you consent to their jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they were last changed. Continuing to use the Site after changes take effect means you accept the updated Terms.
